Variances to Medium Scale Residential Infill Overlay Zoning

EXTERIOR ENTRANCES AT GRADE (Reference Section 823.3.2 (a))
Required for all ground storey ‘Apartment Housing Dwellings adjacent to public roadway.
Proposed: Group Home dwelling units at ground floor without exterior entrances.
Deficiency/Variance Requested: Request variance not to provide exterior entrances for dwelling units on ground floor. Exterior entrances at dwellings undesirable for operations of Family Reunification program.

PRIVATE AMENITY AREA (Reference Section 823.3.(a))
Minimum 7.5 m2 private outdoor amenity per ‘Apartment Housing Dwelling’ (187.5 m2 required)
Minimum 15 m2 private outdoor amenity per ‘Ground Storey Dwelling’ (240 m2 required)
Total Private Amenity Area required = 427.5 m2
Proposed: Proposed total of 488 m2 common amenity area provided at ground level. Private amenity area for dwellings undesirable for operations of Family Reunification program.
Deficiency/Variance Requested: Request variance to accept 488 Sq.m. public amenity area in place of private amenity area.

PRINCIPAL LIVING ROOM WINDOW (Reference Section 48.2.2(d)(e)
4.5 m Privacy Zone between window and abutting on-site parking/amenity area.
Proposed: 2.0 m privacy zone between principal living room window and abutting parking. 850 mm high privacy wall provided, all ‘Apartment parking spaces’ abutting window unlikely to be used as residents do not have car ownership. To account for anticipated parking vacancy, grass concrete pavers provided at all parking spaces abutting windows.
Deficiency/Variance Requested: Request variance to decrease requirement to 2.0 m as proposed on site plan.

HABITABLE LIVING ROOM WINDOW (Reference Section 48.3.3(d)(e)
4.5m Privacy Zone between window and abutting on-site parking/amenity area.
Proposed: 2.0 m privacy zone between principal living room window and abutting parking. 850 mm high privacy wall provided, all ‘Apartment parking spaces’ abutting window unlikely to be used as residents do not have car ownership. PARKING VARIANCE
The parking requirement is 57 stalls (42.5 apartment stalls, 3.6 visitor stalls, 5.3 group home stalls, 5.0 staff stalls).
Proposed: 21 stalls due to the fact that most of these stalls will remain empty as the residents are unlikely to have car ownership.
Deficiency/Variance Requested: Request variance to decrease requirement to 21 stalls as proposed on site plan.
